No, this is quite common among trainers in Creshire.
@Lord Windos You are allowed to have two Pokemon "with you" in the Running, which could include flying above. What you couldn't do is have Lucifer up in the air ready to swoop in and also have, say, Arbok and Wobbuffet out. You'd have to recall one.
If Lucifer is purely scouting, that would be fine.
