Nothing says the Moltres has to stay with Heart forever, or necessarily be used in a battle. They can stay with him long enough for it to grow strong, mature, and independent enough to leave the nest and its father figure, and given that Iron's said that Legendary Pokemon pretty much have a big 'No Rules/Very Loose Rules!' attached to them, it wouldn't be hard just keeping them as an extra in your party (Like Dizzy/Past Calam was to Shiva). Heck, the League might be fully onboard with that plan, given Cheshire's reverence for just about any Pokemon, but especially Legends.
Oh, acting as a guardian of Moltres its more accpetable. This could be a good test to see if Heart is capable of taking care a little baby Moltres and protect him until he became a full legendary phoenix. Thats more like it. Heart also would never use Moltres in battle.
